SP lawyer files suit against Yahoo, Time Warner; featured in two IP Law 360 articles

Attorney Anthony G. Simon of Simon Passanante was featured in two articles that appeared in the July 30 issue of IP Law 360.

Simon represents California-based Creative Internet Advertising Corp. in a patent infringement lawsuit filed on July 29 in a Texas federal court against Yahoo Inc. and Time Warner, parent of AOL. The first article discusses the case.

The patent at the center of the infringement claim entitled “Background advertising system,” describes a system for inserting advertisements in the background of an e-mail message or public posting.

In an interview, Simon told IP Law 360: “Obviously, we think it is a very valuable patent. It’s a way to get the name recognition exposure of a particular brand or trademark without inundating someone with junk email they’re never going to read.”

In addition to Simon Passanante, Creative Internet Advertising is also represented by Longview, Tex.-based Albritton Law Firm and North Carolina-based Ward & Smith.

The three law firms also represent Newport Beach, Calif.-based Parallel Processing Corp. in a suit against Sony Corp. of America. That lawsuit was featured in the second IP Law 360 article.

The patent infringement lawsuit, also filed in a Texas federal court on July 29, involves the PlayStation 3 and a patent entitled “Synchronized parallel processing with shared memory.” That patent describes the partitioning of a computer program into small concurrent processes.
