Motorcyclist hurt in accident with tractor-trailer truck settles suit

June 13th, 2007 by John Simon

A motorcyclist hurt in a collision with a tractor-trailer truck settled his personal injury suit for $500,000. (Engelhardt v. Lowery Carnival Co., et al.)

On May 3, 2005, Plaintiff Richard Engelhardt was driving his motorcycle northbound on US Highway 61-67 in the left lane.  Lowery Carnival Company, Inc.’s driver, Mr. Otis Walker was also northbound on US Highway 61-67 and he was in the right line ahead of Mr. Engelhardt.  As Mr. Engelhardt was negotiating a curve and in an attempt to avoid being hit by Lowery Carnival’s truck, Mr. Engelhardt applied his brakes, slid on the asphalt pavement and struck the left front tractor wheel of the Lowery Carnival Company truck being operated by Mr. Walker.

When examined in St. John’s Mercy Medical Center emergency room, Mr. Engelhardt was found to have a fracture of the left leg, rib fractures, and an abrasion over his left eye.

John Simon of Simon Passanante represented the motorcyclist.
