Ethical Class Action Standards

In a recent deposition, Stuart Rossman, head of litigation for the NCLC, mentioned a set of class action guidelines that deserve highlighting.  They emphasize ethical class actions that serve to protect consumers.  The National Association of Consumer Advocates (NACA), has produced these guidelines in an effort to preserve the class-action mechanism as a means for vindicating consumer rights.

The guidelines advocate the use of class-actions specifically when there are similar but relatively small damage claims that exist on behalf of a fairly large number of individuals.  The guidelines encourage attorneys to seek meaningful recovery for the class representative and members of the class and offer guidance on when class actions are appropriate.
